APPLICANT REQUESTS THAT:
His date of rank (DOR) to major (O-4) be adjusted from 1 January
2013 to 15 April 2012, his six-year anniversary date.

APPLICANT CONTENDS THAT:
His DOR to the grade of major (O-4) was miscalculated and has
cost him eight months of time in service and back pay.
In support of his appeal the applicant provides a copy of his
Air Force Officer Pre-selection Brief.

STATEMENT OF FACTS:
The applicant is a Dental Corps Officer currently serving in the
Regular Air Force in the grade of major.
He was previously promoted to the grade of captain (O-3) with a
DOR of 15 April 2006. He was selected the first time considered
- In the Promotion Zone (IPZ), for promotion to major by the
Calendar Year 2012 (CY12) Major Dental Corps Promotion Board
with a DOR of 1 January 2013.

evaluation prepared by the Air Force office of primary
responsibility at Exhibit C.

AIR FORCE EVALUATION:
AFPC/DPSO recommends denial. DPSO indicates that Air Force
Instruction 36-2501, paragraph A2.4. Eligibility for Promotion
of Medical Corps/Dental Corps Officers, states members who are
selected for promotion IPZ, should be promoted on the sixth
anniversary of their current DOR, or on Senate confirmation of
the promotion, whichever is later.
In the applicants case, the Senate did not confirm his
promotion board results until 1 January 2013 resulting in his
DOR being 1 January 2013 vice 15 April 2012.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to the
applicant on 13 January 2013 for review and comment within
30 days (Exhibit D). As of this date, this office has received
no response.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by
existing law or regulations.
2. The application was timely filed.
3. Insufficient relevant evidence has been presented to
demonstrate the existence of an error or an injustice. We took
notice of the applicant's complete submission in judging the
merits of the case; however, we agree with the opinion and
recommendation of the Air Force office of primary responsibility
and adopt its rationale as the basis for our conclusion the
applicant has not been the victim of an error or injustice.
Therefore, in the absence of evidence to the contrary, we find
no basis to recommend granting the relief sought in this
application.

THE BOARD DETERMINES THAT:
The applicant be notified that the evidence presented did not
demonstrate the existence of material error or injustice; that
the application was denied without a personal appearance; and
that the application will only be reconsidered upon the
submission of newly discovered relevant evidence not considered
with this application.
